1. Acceptance of Terms

By using CoverTest Pro (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

CoverTest Pro is a service provided by CoverTest Pro (“we”, “our”, “the Provider”), based in Italy.

2. Service Description

CoverTest Pro is a service that allows authors and publishers to:

• Test the effectiveness of their book covers
• Compare different versions of covers
• Obtain feedback and metrics on covers
• Use a Chrome extension to facilitate tests

The Service is available through:

• The website covertestpro.com
• The Google Chrome browser extension

3. Dependency on Third-Party Platforms and Technical Limitations

3.1 Nature of the Service and dependency on Amazon

The user acknowledges and expressly accepts that CoverTest Pro is a service that operates by interacting with the Amazon.it website and/or other international Amazon domains (“Amazon Platform”). The Service works through DOM (Document Object Model) manipulation techniques and client-side code injection into Amazon Platform web pages displayed in the user's browser.

CoverTest Pro is not affiliated, associated, authorized, approved, or sponsored by Amazon.com, Inc. or any of its subsidiaries or affiliates. Amazon is a registered trademark of Amazon.com, Inc.

3.2 Technical risks accepted by the user

By using the Service, the user acknowledges and accepts that the operation of CoverTest Pro depends entirely on external factors beyond our control, including but not limited to:

• The HTML, CSS, and JavaScript structure of Amazon Platform web pages
• Security policies and technical restrictions implemented by Amazon
• The availability and accessibility of the Amazon Platform
• Amazon's policies regarding browser extensions and DOM manipulation
• Google Chrome and Chrome Web Store policies regarding extensions
• Any detection and blocking systems for third-party scripts implemented by Amazon
• Changes to algorithms, user interface, or technical structure of the Amazon Platform

3.3 Exclusion of operation guarantee

CoverTest Pro does not guarantee in any way the continuous, uninterrupted, or permanent operation of the Service. The user understands and accepts that:

• Amazon may unilaterally and without notice modify the structure of its web pages, rendering the Service partially or totally non-functional
• Amazon may implement technical measures that prevent DOM code injection or the operation of third-party browser extensions
• Amazon may modify its Terms of Service to explicitly prohibit the use of tools like CoverTest Pro
• Google may remove the extension from the Chrome Web Store or modify Chrome extension APIs in a way that renders the Service non-functional
• Chrome browser updates may compromise the extension's functionality

3.4 Right to discontinue the Service

CoverTest Pro reserves the unquestionable right to suspend, modify, or permanently discontinue the Service at any time and for any reason, including but not limited to:

• Technical changes to the Amazon Platform that make the operation of the Service impossible or impractical
• Formal or informal requests from Amazon to cease the Service
• Removal of the extension from the Chrome Web Store by Google
• Regulatory or legal changes that render the Service non-compliant
• Commercial or strategic assessments by the Provider
• Technical impossibility to maintain compatibility with the Amazon Platform

3.5 Exclusion of refunds for external causes

3.6 Conscious acceptance of risk

By purchasing and using CoverTest Pro, the user declares to:

• Have read, understood, and fully accepted this section
• Be aware that the Service may cease to function at any time for causes external to the Provider's control
• Accept the economic risk arising from the possible interruption of the Service
• Expressly waive any claim for refund for the causes listed above
• Understand that the Service price reflects this risk allocation

4. Account and Registration

4.1 Account creation

To use the Service, you must create an account by providing accurate and complete information. You can register via Google OAuth authentication.

4.2 Account responsibility

You are responsible for:

• Maintaining the confidentiality of your credentials
• All activities occurring through your account
• Immediately notifying us of any unauthorized use

4.3 Multiple accounts

Each user may maintain only one account. Creating multiple accounts to circumvent usage limits, abuse the refund policy, or for any other purpose is strictly prohibited and may result in the termination of all associated accounts without refund.

4.4 Age requirements

You must be at least 16 years old to use the Service. By using the Service, you declare that you meet this requirement.

5. Plans and Purchases

5.1 Available plans

5.2 Payments

• Payments are processed by LemonSqueezy, our payment service provider
• By accepting these Terms, you also accept LemonSqueezy's Terms
• The Premium plan is available as a one-time payment that grants a lifetime license
• No recurring charges or automatic billing will apply to your purchase
• Prices are indicated in EUR and include applicable VAT where required

5.3 Lifetime License

• The Premium plan grants a lifetime license, defined as access to the Service for the entire operational life of the product
• The license includes all future updates, improvements, and new features released during the product's operational life, at no additional cost
• The lifetime license is personal, non-transferable, and non-sublicensable
• The license is tied to your CoverTest Pro account and may not be shared with or transferred to third parties
• One license is valid for a single user only
• CoverTest Pro reserves the right to discontinue the Service as described in Section 3.4; in such case, the lifetime license terminates accordingly

5.4 Account Deletion

• Since the Premium plan is a one-time purchase, there is no subscription to cancel
• You may request deletion of your account at any time by contacting support@covertestpro.com or using the contact page
• Account deletion is permanent and results in the irreversible loss of your license and all associated data
• Account deletion does not entitle you to a refund

5.5 Refund Policy

How to request a refund

You can request a refund through any of the following methods:

• Email us at support@covertestpro.com
• Use the contact form on our website
• Request directly through LemonSqueezy's customer portal

Refund processing

• Refunds are processed and issued entirely by LemonSqueezy
• Processing time is approximately 10 business days from the approval of the request
• CoverTest Pro is not responsible for any delays in refund processing or disbursement by LemonSqueezy
• The refund will be issued to the original payment method used for the purchase

Effects of a refund

• Upon refund approval, your Premium license will be immediately revoked
• You will lose access to all Premium features
• Your account will revert to the Free plan
• Any data associated with Premium features may be deleted

Refund abuse prevention

• The 30-day money-back guarantee may be exercised only once per person, regardless of the email address, payment method, or account used
• If a refund has been previously issued to you, any subsequent purchase will not be eligible for the money-back guarantee
• CoverTest Pro reserves the right to deny refund requests in cases of suspected abuse, including but not limited to: repeated purchase-and-refund cycles, use of multiple accounts, or any behavior intended to circumvent this policy

Chargebacks and payment disputes

6. License and Intellectual Property

6.1 License to use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

6.2 Restrictions

You may not:

• Copy, modify, or distribute the Service
• Decompile, disassemble, or attempt to extract source code
• Remove copyright or proprietary notices
• Use the Service for illegal purposes
• Share your license with third parties
• Use bots, scrapers, or unauthorized automated tools

6.3 License suspension and deactivation

6.4 Intellectual property

• The Service, including software, design, logos, and content, is our property
• Your content (uploaded covers) remains your property
• You grant us a limited license to process your content in order to provide the Service

7. Chrome Extension

7.1 Installation

The extension is available on the Chrome Web Store and must be installed following standard Google Chrome procedures.

7.2 Extension license

The license for the extension is tied to your CoverTest Pro account. One license is valid for a single user.

7.3 Activations

• Free plan: 1 device
• Premium plan: Multiple devices (according to purchased plan)

7.4 Chrome Web Store compliance

The extension complies with Chrome Web Store policies. Use of the extension is also subject to Google Chrome Terms of Service.

8. Acceptable Use

8.1 You agree to:

• Use the Service only for legitimate purposes
• Respect third-party intellectual property rights
• Not upload illegal, offensive content, or content that violates third-party rights
• Not attempt to access unauthorized systems or data

8.2 Prohibited content

You may not use the Service to test covers that:

• Contain illegal material
• Violate third-party copyrights
• Contain obscene or pornographic material
• Promote hatred, violence, or discrimination
• Contain malware or harmful content

8.3 Consequences of violations

In case of violation, we may:

• Suspend or terminate your account
• Remove violating content
• Take legal action if necessary

9. Availability and Maintenance

9.1 Availability

• We commit to keeping the Service available, but do not guarantee 100% uptime
• Scheduled interruptions will be communicated in advance when possible

9.2 Service changes

We reserve the right to:

• Modify Service features
• Add or remove features
• Modify plans and prices for future purchases (with 30 days notice)

9.3 Service interruption for internal causes

In case of voluntary cessation of the Service by us (not caused by external factors):

• We will provide at least 60 days notice
• For purchases made within the preceding 30 days, we will offer a full refund
• For purchases made more than 30 days prior, refunds will be at our sole discretion, taking into account the nature and timing of the cessation

9.4 Interruption for external causes (reference to Section 3)

In case of Service interruption caused by factors external to our control (as detailed in Section 3 “Dependency on Third-Party Platforms”), no refund will be due and the notice terms above will not apply.

10. Limitation of Liability

10.1 Disclaimer of warranties

The Service is provided “as is” and “as available”. We do not guarantee that:

• The Service will be uninterrupted or error-free
• The results obtained will be accurate or reliable
• The Service will meet your specific needs
• The Service will remain compatible with the Amazon Platform or Google Chrome
• The Service will continue to be available for any period of time

10.2 Disclaimer of liability for third-party platforms

10.3 Limitation of damages

To the maximum extent permitted by law, we will not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the Service
• Damages arising from Service interruption for external causes
• Damages arising from incompatibility with Amazon or Chrome

10.4 Maximum limit

Our total liability will not exceed the total amount paid by the user for the Service, with a maximum of EUR 100.00.

10.5 Exceptions

The above limitations do not apply to:

• Damages caused by willful misconduct or gross negligence
• Violations of non-waivable EU consumer rights
• Death or personal injury caused by our negligence

10.6 Force majeure

We will not be liable for delays or non-performance due to force majeure causes, including but not limited to: natural disasters, pandemics, epidemics, wars, acts of terrorism, riots, embargoes, governmental actions, third-party service interruptions (including Amazon, Google, hosting and payment providers), infrastructure failures, cyberattacks, network or power outages, and any other circumstances beyond our reasonable control.

10.7 Data responsibility and backups

The user is solely responsible for backing up their data, projects, configurations, and any other content uploaded or created through the Service. We do not guarantee permanent data retention and will not be liable for data loss due to any cause, including technical malfunctions, Service cessation, or user error.

11. Indemnification

You agree to indemnify and hold harmless us, our officers, employees, and suppliers from any claim, damage, loss, or expense (including legal fees) arising from:

• Your violation of these Terms
• Your violation of third-party rights
• Content you upload to the Service

11.1 Specific indemnification for third-party actions

The user acknowledges that use of the Service occurs at their own exclusive responsibility. In particular, the user agrees to indemnify and hold harmless CoverTest Pro from any:

• Legal action, claim, or compensation request from Amazon.com, Inc. or its affiliates
• Legal action, claim, or compensation request from Google LLC or its affiliates
• Consequence arising from the user's violation of Amazon or Google Terms of Service
• Suspension or closure of the user's Amazon or Google account related to Service use

12. Termination

12.1 By you

You can terminate your account at any time:

• By requesting account deletion via email to support@covertestpro.com
• By using the contact form on our website

12.2 By us

We may suspend or terminate your account:

• In case of violation of these Terms
• In case of fraudulent or illegal activities
• To protect other users or the Service

12.3 Effects of termination

Upon termination:

• Your access to the Service terminates immediately
• Your Premium license, if any, will be permanently revoked
• Your account data will be retained for 30 days, then deleted
• You will not be entitled to refunds (except as provided in Section 5.5 and subject to exclusions in Section 3.5)

13. Changes to Terms

13.1 Updates

We may modify these Terms. In case of substantial changes:

• We will notify you via email with at least 30 days notice
• We will post the new Terms on the site

13.2 Acceptance

By continuing to use the Service after the changes take effect, you accept the new Terms. If you do not accept, you must stop using the Service.

14. General Provisions

14.1 Applicable law

These Terms are governed by Italian law.

14.2 Competent jurisdiction

For disputes with consumers residing in Italy/EU, the jurisdiction of the consumer's place of residence is competent.

14.3 Alternative dispute resolution

Before pursuing legal action, the parties commit to attempting an amicable resolution of the dispute.

14.4 Severability

If a provision of these Terms is deemed invalid, the other provisions remain in effect.

14.5 Waiver

Failure to enforce a right does not constitute waiver of that right.

14.6 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.

16. EU Consumer Rights

If you are a consumer residing in the European Union, you have non-waivable rights that cannot be limited by these Terms, including:

• Right of withdrawal: You have a minimum 14-day right of withdrawal under EU law. CoverTest Pro voluntarily extends this to a 30-day money-back guarantee as described in Section 5.5
• Legal guarantee: The Service must comply with the contract
• Data protection: Rights provided by GDPR (see Privacy Policy)
